1. Introduction
This Warranty Disclaimer sets forth the terms and conditions of the warranty provided by Solomons Adventure Sports in connection with the fishing and outdoor equipment sold on our website https://www.solomonsadventure.co.za/.
2. Warranty Agreement with Suppliers
The warranty for products sold by Solomons Adventure Sports is provided by the specific supplier of the product, not by Solomons Adventure Sports itself. Solomons Adventure Sports acts as a retailer and does not offer any warranties of its own on the products sold.
3. Warranty Applicability
The warranty is applicable only to the original owner of the product and is not transferable. Proof of purchase must be provided when presenting a warranty claim.
4. Warranty Scope and Remedies
In the event of a defect, the supplier, at their sole discretion, will either:
- Replace the defective product with a product of similar quality and nature.
- Repair the defective product.
- Refund the purchase price, upon presentation of the proof of purchase.
Non-defective components may be replaced at the customer’s expense. In such cases, Solomons Adventure Sports will contact the customer for agreement before replacing any non-defective parts.
5. Exclusions from Warranty
The warranty does not cover any labor charges associated with the replacement or changeover of parts. Additionally, the warranty does not cover damages resulting from misuse, abuse, unauthorized modification, improper storage, maintenance, or installation of the product.
6. Shipping Costs for Warranty Service
The customer is responsible for any shipping costs incurred in sending the product to and from Solomons Adventure Sports for warranty service. However, customers have the option to take the product to the nearest local dealer for warranty purposes if they prefer.
7. Limitation of Liability
Solomons Adventure Sports shall not be liable for any special, indirect, incidental, or consequential damages that may result from the use of, or the inability to use, the equipment sold on its website, even if Solomons Adventure Sports has been advised of the possibility of such damages.
8. Governing Law
This Warranty Disclaimer shall be governed by and construed in accordance with the laws of the jurisdiction in which Solomons Adventure Sports operates.
